Throughout most of the United States, the legal limit for your blood alcohol concentration (BAC) is .08%. In Utah, a lower limit applies. You are presumed to be driving while impaired in Utah if you are above the state’s legal limit of .05% while in control of a vehicle. This lower BAC limit went into effect on December 30, 2018. You can also be charged with DUI if you are under the influence of alcohol, any drug or any combination of alcohol and drugs that renders you incapable of operating your vehicle safely. For drivers under 21, Utah also has a zero-tolerance policy. The state’s so-called Not-A-Drop statute results in underage drivers facing conviction and penalties if they operate a motor vehicle with any detectable amount of alcohol in their system.
